BUSINESS RISKS: A REVIEW OF THE EVOLUTION OF DOCTRINE, LEGISLATION AND JUDICIAL PRACTICE

Abstract
An inherent property of entrepreneurial activity is risks. As a result of the analysis of the evolution of the legal regime of entrepreneurial risks, it was established, in particular, that it is first determined by customs and judicial acts and only then receives regulatory approval.
The article examines the features of the legal regime of entrepreneurial risks in the pre-revolutionary, Soviet and post-Soviet periods.
The subject of special attention is the analysis of doctrinal judgments about the legal nature of business risks and related concepts.
