CRIMINAL LIABILITY FOR THE ORGANIZATION ILLEGAL MIGRATION

The article examines historical periods of state development in the field of setting norms that provide for responsibility for unlawfully suppressing the state border of Russia, as well as for organizing illegal migration. The purpose of this article is to form an orderly view of the phenomenon of the organization of illegal migration, its legislative regulation through the prism of norms both before the Soviet, Soviet and modern criminal legislation of the periods of development of the Russian state. The methods used are formal-logical, historical, system-structural methods of investigation. In addition, the author used methods of induction, deduction, analysis and synthesis. The result is an orderly representation of the development of norms that criminalize the organization of illegal migration in all historical periods of the development of the Russian state. The received results can be applied at perfection of a regulation of the criminal liability for the organization of illegal migration under the current Russian criminal legislation. The conclusion to which the author came is that the main trends in the development of responsibility for the alleged encroachment in the history of domestic criminal legislation are the gradual separation of acts aimed at organizing illegal migration into an independent crime component, as well as the transfer of responsibility for this assault from a group of crimes against the state power to the category of public dangerous acts that damage the management order. It is also important to note that the analysis of the history of the development of criminal legislation in the sphere of criminal liability regulation for organizing illegal migration shows that one of its tendencies is: the gradual separation of this act into an independent crime along with the following socially dangerous acts: crossing the state border, violation of the rules stay in the country, illegal entry into the country.
