PARENTS 'RESPONSIBILITIES FOR SECURITY OF THE INFORMATIVE CHILDREN AND ADMINISTRATIVE RESPONSIBILITY FOR DUTIES

The article is devoted to the analysis of modern legal regulation of relations that arise when parents (persons who replace parents) of minors fulfill their responsibilities for the upbringing and development of the child, including information about minors, and also when the guilty parent is brought to administrative responsibility for non-compliance with obligations under the the upbringing of children. The aim of the work is to characterize Russian standard regulation regulation regulating relations for the realization of the right of a minor to protect information that harms his health, morality, intellectual and other development, and also establishes the duty of parents to ensure the realization of this child's right and administrative responsibility for the non-observance or improper execution of duties. In addition, the present legal regulation of the above-mentioned relations is critically analyzed by the authors of the article with a view to identifying gaps in legal regulation and formulating proposals to address such gaps in legislation. The methodological basis of the research is composed of such methods and techniques of scientific knowledge as: dialectical-materialistic, analysis and synthesis, sociological, comparative legal, formally legal, with the help of which authors were able to analyze the special aspects of the legal regulation of parents relations of minors to their duties in education, physical, intellectual and other development of the child, protection of his rights and legitimate interests. In the course of the study the problems of law enforcement practice of territorial commissions on juvenile affairs and protection of their rights were identified in determining the objective side of administrative offense for parents of minors provided for by the part 1 of Article 5.35 of Russian Federation Administrative Offence Code. And also the gaps in the legal regulation of the mechanism for the realization of child's right to protection from information, which is harmful to the health, physical, moral and other development of the minor. The result of the study is the proposal to improve the legal regulation of relations arising in the parents' performance of their child's responsibilities for its proper upbringing and development which, in turn, will improve the law enforcement practice of such extrajudicial body with jurisdictional powers as commissions on juvenile affairs and protection of their rights.
